14th April 2010 - Penalty regime becomes more penal

    The Times today published a story of an unrepresented taxpayer who claimed a repayment of £3,000. HMRC investigated and found he was only entitled to a repayment of £1,000. They charged him £1,400 penalties, 70% of the overclaimed rebate. The story is reported as a genuine error and highlights the much higher rates of penalties that HMRC are going for in practice.

    Hornbeam comments:

    • HMRC’s argument that penalties of up to 100% have always been available, is disingenuous, as in practice inspectors usually agreed penalties in the range of nil to 50% for small cases of genuine error. The new regime is much nastier.
    • This case demonstrates the potential cost of going it alone, or using an unqualified advisor who has no public liability insurance.

12th April 2010 - Furnished Holiday Lets regime reprieved

    As part of the election settlement with the conservatives, the Government have agreed that the furnished holiday lets regime can continue for another tax year. The regime was to be abolished at 5th April 2010, it will now continue for at least another 12 months. 26th, 27th & 28th March 2010 - Hornbeam attended 'A Place in the Sun Live' at Earls Court

    Hornbeam Director, Phil Needham, sat on a panel with representatives from The International Property Law Centre and the Foreign and Commonwealth Office in the 'Emigrating to Europe' seminar between 12:00 and 12:45 each day. During each session Phil fielded some interesting questions from both members of the panel and the packed audience. Some of these questions and the answers are available here. Hornbeam also gave out advice and copies of our leaflets, the Hornbeam Guides to Taxation for Emigrants and UK Taxation of Overseas Property at our trade stand.
